These terms and conditions set out the terms between customers registered on www.BETDAQ.co.uk and www.BETDAQ.com (“you”, “your”) and Global Betting Exchange Limited (“we”, “us”, “our”) and our respective successors and assigns under which you may access the BETDAQ forum (the “Forum”). Your use of the Forum means that you accept, and agree to abide by, all of the then current Forum terms and conditions (the “Forum Rules”), which supplement our terms of website use. To post on the Forum you must be at least 18 years old, have a funded BETDAQ account and accept and agree to abide by and be bound by the Forum Rules. You will be given the opportunity to review and accept the Forum Rules when you register on the Forum. You must be logged into a BETDAQ site to post to the Forum. If you are not logged in, you will only be able to view posts on the Forum, you will not be able to post. When you register on the Forum you will be prompted to enter a nickname to use the Forum. For security reasons this nickname is required to be different from your BETDAQ username. It is not possible to change your nickname once you have selected it. Note only the registered BETDAQ account user can use the nickname specified for their Forum account. You are responsible for all acts, deeds and omissions when your BETDAQ username or Forum nickname is used in connection with the Forum. The official language of the Forum is English. Posts to the Forum must be in English. Prohibited Uses You may use the Forum only for lawful purposes. You may not use the Forum: - In any way that breaches any applicable local, national or international law or regulation.
- In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
- To send, receive, upload, download, use, re-use or link to any material which does not comply with our Content Standards (see below).
- To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
- To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
Moderation We reserve the right to oversee, monitor or moderate the Forum, however, we are under no obligation to do so and we expressly exclude our liability for any loss or damage arising from the use of the Forum by you, whether the Forum is moderated or not. We reserve the right to suspend or ban a Forum user or to remove, edit, move or close any thread at any time and for any reason in our absolute discretion. Content Standards These content standards apply to any and all material which you contribute to the Forum (“Contributions”). You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any Contribution as well as to its whole. Contributions must: - Be accurate (where they state facts).
- Be genuinely held (where they state opinions).
- Comply with applicable law.
Contributions must not: - Contain any material which is defamatory of any person.
- Contain any material which is obscene, offensive, hateful or inflammatory.
- Promote sexually explicit material.
- Promote discrimination based on race, s,ex, religion, nationality, disability, sexual orientation or age.
- Infringe any copyright, patent, database right or trade mark of any other person.
- Be likely to deceive any person.
- Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
- Promote any illegal activity.
- Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
- Be likely to harass, upset, embarrass, alarm or annoy any other person.
- Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
- Give the impression that they emanate from us, if this is not the case.
- Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
Suspension and Termination We will determine, in our discretion, whether there has been a breach of the Forum Rules through your use of the Forum. When a breach of the Forum Rules has occurred, we may take such action as we deem appropriate. Failure to comply with the Forum Rules constitutes a material breach of the terms of use upon which you are permitted to use our site, and may result in our taking all or any of the following actions: - Immediate, temporary or permanent withdrawal of your right to use the Forum and/or our site.
- Immediate, temporary or permanent removal of any posting or material uploaded by you to the Forum.
- Issue of a warning to you.
- Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
- Further legal action against you.
- Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
We exclude liability for actions taken in response to breaches of the Forum Rules. The responses described in the Forum Rules are not limited, and we may take any other action we reasonably deem appropriate. LiabilityYou assume total responsibility and risk for your use of and participation in the Forum. We shall not be responsible or liable under any circumstances for any direct, indirect, incidental, special, consequential or other damages arising out of or in any way related to the Forum. If you are dissatisfied with the Forum Rules, your sole remedy is to cease use of the Forum. We do not warrant or make any representation regarding the correctness, accuracy, timeliness, reliability or any other aspect of Contributions or other materials on the Forum. The views expressed in Contributions are those of the individual contributors and not necessarily ours.IndemnityYou agree to indemnify, defend and hold us harmless from and against any and all claims, losses, liability, costs and expenses (including legal fees) incurred by us in connection with or arising out of Contributions and/or your participation in the Forum. In the event that Contributions infringe any rights of any third party, you shall, at your own expense and at our discretion, either obtain the right to use such Contribution or render such Contribution free of any infringement.LicenceYou acknowledge that by participating in the Forum, you are granting us the unrestricted right, throughout the world and in perpetuity, to copy, sublicense, adapt, transmit, perform, display or otherwise use, at no cost whatsoever to us, any and all Contributions including, without limitation, all intellectual property rights embodied therein. Changes To the Forum Rules We may revise the Forum Rules at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in the Forum Rules may also be superseded by provisions or notices published elsewhere on our site.
